Ifocus International Ltd (‘Hercules® Instant Shelter’)owns and operates this website. These terms and conditions of Hercules® Instant Shelter sale constitute a binding agreement between  (us/we) and its customers (you) which applies to all purchases of items by you from the website(www.herculesgazebo.co.nz).

TERMS OF WEBSITE USE

By using this Site, you agree to be bound by Hercules® Instant Shelter’s Terms of Use, in addition to other terms and conditions that may appear throughout our Sites.
We reserve the right to make changes to this Site and its Terms of Use at any time. Each time you use this Site, you should visit and review the then-current terms of use that apply to your transactions and use of this Site. If you do not agree to be bound by the then current Notices and Policies, please do not use this website.

 

Security

We cannot guarantee the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website. This website may be inaccessible from time to time due to events outside our control or maintenance requirements.

 

Limitation of liability

While we will use reasonable endeavours to verify the accuracy of any information we place on the website, however, we make no warranties, whether express or implied in relation to its accuracy.

THE TERMS OF PURCHASE

The Agreement

In addition to the Terms of Use, these terms and conditions (“the Purchase Terms”) set out the additional terms and conditions under which you may purchase from Hercules® Instant Shelter’s products appearing on this website. By completing the customer application process and purchasing products from this website(www.herculesgazebo.co.nz), once Hercules® Instant Shelter accepts an order, an agreement exists between Hercules® Instant Shelter(us/we) and its customers(you). Each accepted order is a separate agreement.

Prices

All prices listed include GST(Goods and services tax) at the New Zealand standard rate of 15%. Due to circumstances beyond our control prices may have to be increased or decreased including any alterations to GST. The correct price you will pay will be on your printed order confirmation. Any special offers will be priced accordingly showing the specific period this item is on special offer for.

 

Order acceptance

Order acceptance and the completion of the contract between you and us will take place on the dispatch of the products ordered to you unless we have notified you that we do not accept your order or you have cancelled it in accordance with our cancellation policy. Non-acceptance of an order may be a result of one of the following: – Our inability to obtain authorisation for your payment – The identification of a pricing or product description error – You not meeting the eligibility to order criteria set out in the main Terms & Conditions, If there are any problems with your order, you will be contacted by our Customer Services Representatives. The sales contract is therefore completed in New Zealand. We reserve the right to reject any offer to purchase by you at any time.

 

Product Availability

We use our best endeavours to ensure products ordered are available for delivery, and in most cases will notify you where a product is unavailable prior to you completing your order. However, you acknowledge that in some cases this is not possible and we may need to reject an order you have placed for a product where we establish that it is actually unavailable for delivery. In such cases, we will refund in full all amounts you paid in respect of such unavailable product.

 

Promotions & Offers

We reserve the right to modify, cancel and limit any promotion or offer. We reserve the right to refuse to provide offers and/or promotions to particular individuals or organisations at our discretion. No warranties or guarantees are made. All material is copyright Hercules® Instant Shelter or to the third party mentioned. The material cannot be published in any form without prior written approval by us. By using any techniques or resources provided, you accept all liability for your actions.

 

Payment

All orders are payable in full before delivery. We will continue to own and reserve the right to repossess any goods sold under contract until payment has been received in full. We accept all major credit cards/debit cards VISA, Mastercard, You confirm that the credit or debit that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

 

Deliveries 

Deliveries are within New Zealand only, and will not ship internationally.
We will normally send your order from our Auckland warehouse. Delivery time is dependent on our warehouse’s inventory levels. If an item is in-stock, we will dispatch the item out to you within 1-3 working days, after your order has been processed. Your order will be shipped to you mostly via Toll NZ and PBT Freight. And you will receive a confirmation email to confirm that your order has been shipped.
  • Local deliveries (within Auckland). – Orders received before 1 pm will be dispatched that day. Delivery is usually 1-3 working days.
  • North Island – Orders received before 1 pm will be dispatched that day. Delivery is usually within 2-4 working days.
  • South Island – Orders received before 1 pm will be dispatched that day. Delivery is usually within 2-5 working days.
  • Rural Area Deliveries – Additional Delivery Fee may apply. May take 1-3 additional days.
1) Orders On Friday After 1 pm

Orders made after 1 pm on Friday will not be processed and dispatched until Monday.

2) Holiday Season, Public Holidays and Weekends

Our courier service does not deliver on weekends or Public holidays. During the peak holiday seasons please allow an extra 2 – 3 working days for delivery. You will be asked an extra cost if you request a weekend delivery from courier without our authorisation.

3) Out Of Stock

If the item is out of stock in our Auckland warehouse, but still have stock in one of our store branches in the country, we will send the item directly from the store to you without additional costs.  If this is the case, the delivery may take a little longer. If the item you order is out of stock in the country, we will contact you for a solution.

4) Courier damages or missing goods:

All of our items are checked before dispatch and leave our warehouse in perfect condition. If you receive your goods and they are damaged, do not take receipt of the goods or sign for them. The courier will then return the goods to Hercules Instant Shelter. The customer MUST notify Hercules Instant Shelter within 24 hours if this occurs. Failure to do so may result in the customer being liable for the goods. We will arrange prompt corrective action and resend your order.

 

Return & Refund

You can return an item within 14 days of the original purchase date(same as the delivery date) for a refund or exchange. Returns are subject to restocking fees of 15% of the purchase price and return handling fees. This policy does NOT apply to bespoke products.  To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. If 14 days have gone by since your purchase, unfortunately, we can’t offer you a refund or exchange.
1) Bespoke product is Non-refundable. 

If an item has been made to the consumer’s specifications or personalised, which means it has been altered from ‘standard’ to ‘bespoke’, it will become non-refundable. No refund can be made once the order is processed. Any claims for defects, damages, or missing parts due to our error, please contact us within 30 days of the original purchase(same as delivery date). If 30 days have gone by since your purchase, unfortunately, we can’t offer you a return or exchange.

Examples of ‘bespoke’ items include: custom printed display, customised gazebo, etc.

2) Faulty items
You must check the item for faults or damages immediately and report it to us.
We provide a limited manufacturing warranty on all products from the date of original purchase that the product will be free from defect in material and workmanship. The length of the limited warranty may vary by product. We reserve the right to reject any return.

CHANGES/UPDATES TO TERMS AND CONDITIONS

Hercules® Instant Shelter reserves the right to make changes to this Site and its Terms of Use at any time. Each time you use this Site, you should visit and review the then-current terms of use that apply to your transactions and use of this Site. If you do not agree to be bound by the then current Notices and Policies, please do not use this website.
